There is, of course, another side to this story; many people who are quite
sympathetic to the Native Americans' position on the merits are a little
troubled by the reach of the remedies the trial judge has ordered.  Those
people will look at today's ruling and see, not the dangers of the Patriot
Act, but the dangers of subordinating the operations of an entire federal
department to the orders of a single district judge.  Professor Pierce's
