Jaynes is not just being prosecuted for sending spam, but for committing fraud (he peddled non-existent products via email such as a "FedEx refund processor" that supposedly allowed people to earn $75 an hour while working from home); 2. He's supposedly made over $24 million and has hidden much of it in overseas bank accounts, so the high bail is justified.*
He may not have killed anyone, but he has certainly made old age much more difficult for the people he defrauded of their life savings.
