_______________ Forward Header _______________ Subject: [for IP] eBay India CEO arrested for sale of porn on auction site Author: Srini RamaKrishnan <cheeni@cmu.edu> Date: 19th December 2004 7:15:07 pm The CEO of eBay India (called Baazee.com) was arrested on Dec. 17th in connection with a scandal involving sale of a pornographic video CD on the site. This is the latest episode in a series of police actions that have occured since the popular news media reported that an alarming number of mobile phone users in India have exchanged MMS messages including a video attachment of a Delhi high school student couple engaged in various sexual acts. The police may have finally bitten off more than they can chew. The arrest seems to be completely unjustifiable under the cited sections of the Indian Penal code and the Information Technology Act. This will hopefully become an important test case for ISP/website liability under Indian law, if it ever reaches an appellate court.
