Or a song. Or a book. Or an article. Or a piece of software. Any copyrightable work. (C) by the distribution of a work being prepared for commercial distribution, by making it available on a computer network accessible to members of the public, if such person knew or should have known that the work was intended for commercial distribution. This will be useful to Sony when they want to crush the distribution of Fiona Apple's unreleased record, after all, the only thing that is necessary is that "the copyright owner has a reasonable expectation of commercial distribution". Title III seems useful (reauthorization of the National Film Preservation bodies) Title IV is very amusing. Ooo! Excellent! They are addressing the Orphan Works issue. Not.
