Dave (and David), there's another, important, issue not being discussed:

He was being investigated for financial fraud, not for perfectly  
legal nudie images.  Yet the latter made it into the press.

It's one thing to have evidence presented in open court (and the  
usual rules of evidence give the defense an opportunity to block  
public disclosure, though I don't know how often that happens).  But  
disclosing stuff that has nothing to do with an ongoing criminal  
_investigation_ is utterly unreasonable.

I understand that stuff can be discovered "in the moment" -- e.g.  
while serving someone with a traffic warrant the cop sees illegal  
drugs on the table -- but that's not the issue here.
