Am I right in thinking that the satellites which carry XM and Sirius are
high enough to be in the outer space equivalent of international waters?

There's *got* to be some minor country out there willing to solve this
problem once and for all by acting as a "flag of convenience" for radio
satellites -- and thus exempting them from regulation for all practical
purposes -- just as Liberia does for cruise ships.

If the FCC wants to be hard nosed enough to force XM and Sirius to move
their studios to the minor country as well, let 'em.
