Dave,

Optimum online will throttle bandwidth to heavy bandwidth during
"4-11pm" localtime.  Colleague of mine has teenagers, and when said link
(approximately 16Mbps/3Mbps capacity) is very busy during evening hours,
optimum will then for some period (typically less than a week) throttle
your traffic during those same hours.

Black box testing indicates that "unlimited" usage during the dark hours
of the night and no throttle is put in place.

IMHO, of the various issues presented, and methods, it seems to be the
most fair of all. Connection still operable, at a lower rate, but no
particular protocol is singled out.  That's aside, but just thought I
would share the info on what one cable MSO's approach is.
