Note that MIT's ITS machines were online under TCP on the flag day, which was NOT true of berkeley unix


UDel got a contract from Arpa to do Arpanet(ncp)/Internet(tcp) email relaying, in anticipation of transition "challenges". We were running BSD and the gateway was operational before flag day.

That means that BSD had TCP significantly before the January, 1983 flag day.
